The Sunday School’s Record Store Day Picks Sweepstakes (“Contest”) entry period begins at 9:00:00 a.m. Eastern Standard Time (EST) on April 18, 2015 and ends at 12:00:00 a.m. EST on April 19, 2015 ("Entry Period"). Entries received before or after the Entry Period will not be accepted or be eligible to win the stated Prize (as defined below), except as otherwise set forth in these Official Rules. Sponsor’s clock is the official clock of the Contest. The potential winner of the Contest will be notified on or around April 20, 2015 via Twitter comment by the Twitter handle: @SundaySchool. Upon verification of eligibility, the potential winner will be declared the Contest winner.2. ELIGIBILITY:
The Contest is open only to participants who are at least eighteen (18) years of age at the time of entry and legal residents of the 50 United States or the District of Columbia, excluding residents of AK and HI. To be eligible, participants must also have a Twitter account. Obtaining a Twitter account is free. Employees, agents, officers, and directors of Made Event, LLC (“Sponsor”) and each of their parent, subsidiaries and affiliated companies, advertising, promotion or production agencies, prize providers and their immediate family members or individuals residing in their same household, are not eligible to participate or enter. Void in AK, HI, Puerto Rico, U.S. territories and possessions and wherever prohibited or restricted by law.3. HOW TO ENTER:
In order to enter, participants must register for a Twitter account (free), if participant does not already have a Twitter account, and “follow” @SundaySchool. You must be “following” @SundaySchool on Twitter during the Entry Period, in order to be eligible.
During the Entry Period, @SundaySchool will tweet a series of tweets with the hashtags: #SundaySchoolPicks and #RecordStoreDay, featuring favorite albums by Sunday School alumni over the past year. To enter, retweet any of the #SundaySchoolPicks #RecordStoreDay tweets by @SundaySchool during the Entry Period.
All timely retweets will automatically be entered in the Contest. Participants may retweet multiple tweets, but only one retweet per tweet shall be accepted. Multiple retweets of the same tweet may result in disqualification, including the creation of multiple Twitter accounts by the same participant in an attempt to enter multiple times. One winner will be selected. Sponsor reserves the right to select multiple winners. Winner(s) will be randomly generated from all eligible participants. If selected, you will be required to provide evidence of eligibility before being identified as a winner. Sponsor reserves the right to select an alternate winner if it deems necessary.
No sponsorship, endorsement or authorization of the Sponsor by Twitter is intended or implied in these Contest; nor is Twitter associated with the Contest in any way. Any questions, comments or complaints about the Contest should be directed to Sponsor. It is the sole responsibility of each participant to review and comply with all policies of Twitter (including, but not limited to any terms of service, community guidelines and privacy policies).4. PRIZES:
There will be one (1) prize (“Prize”) awarded to the winner of the Contest (unless multiple winners are selected, at Sponsor’s discretion). The Prize will consist of: two (2) weekend General Admission Passes (the “Passes”) to the Electric Zoo festival (“Electric Zoo”) being held at Randall’s Island Park in New York City, New York from September 4, 2015 through September 6, 2015 (Total Approximate Retail Value (“ARV”): $500.
Passes are subject to issuer’s ticketholder agreement. Sponsor is not responsible if Electric Zoo is delayed, postponed or cancelled for any reason. Winner will not receive compensation from Sponsor for the Passes if the winner is unable to use the Passes due to cancellation, postponement or delay of the Electric Zoo, but the Passes may be subject to standard rain-check policies and procedures set by the issuer. Sponsor is not responsible for lost, misplaced or destroyed Passes. All incidental expenses not expressly set forth in the Prize package will be winner’s responsibility. Sponsor is not responsible for any travel, lodging, souvenirs, food/beverage or other expenses associated with attending Electric Zoo or using the Prize. No substitution, cash redemption or transfer of the Prize by winner is permitted, but Sponsor reserves the right to substitute a prize of equal or greater value. Winner will coordinate with Sponsor to obtain the Passes. Prize consists of only those items specifically listed as part of the Prize. All federal, state and local taxes on prize value are the sole responsibility of the winner. The Prize is non-transferable.5. NOTIFICATION OF WINNER:
The potential winner will be notified via direct message on Twitter from the @SundaySchool Twitter account. The potential winner must then respond to such notification within forty-eight (48) hours by responding to the private message on Twitter with the information requested in the notification. In the event that a potential winner does not respond to the notification within forty-eight (48) hours of notification, or potential winner is unable to attend the Electric Zoo Festival for any reason, a disqualification may result, and the Prize may be forfeited. In such event, another participant may be randomly selected and awarded the Prize, time permitting. Any alternate winners will be granted forty-eight (48) hours to respond if a potential winner fails to comply with any of the obligations, requirements, terms or conditions of these Official Rules or is found to be ineligible or unqualified for any other reason. Potential winners and their guests may be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability, and, if legally permissible, Publicity Release (collectively, “Releases”) within the time period specified by Sponsor. If a potential winner fails to complete and return any required Releases within the specified time period, that potential winner may be disqualified and an alternate winner may be randomly selected. Winners may be required to produce government-issued identification.6. RELEASE:
By participating in the Contest, participants agree to be bound by the Official Rules and the decisions of the judges. By participating in the Contest, participants hereby waive and release, and agree to hold harmless the Sponsor, Twitter, and their respective parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies and all of their respective officers, directors, employees and representatives and agents (the “Released Parties”), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the Prize, or their participation in this Contest, or any Contest or Prize-related activity. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Contest or use or redemption of the Prize.7. OWNERSHIP AND PUBLICITY:
By entering the Contest, participant grants Sponsor and its parent companies, affiliates, subsidiaries, agents and licensees, a royalty-free, unconditional, irrevocable, and perpetual right, license and consent, without any compensation, consideration or further notification, to use and refer to the participant, his or her name, likeness, image, distinctive characteristics, city, state, any statements made and prize information, for any purpose, including but not limited to editorial, advertising, trade, commercial, and publicity purposes in any media throughout the world, including Twitter, unless prohibited by law. Sponsor also has the right to arrange for the news media and journalists to attend and, if applicable, record, any public appearances and statements of the Prize winner. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder.8. LIMITATION OF LIABILITY:
Sponsor and its respective agencies are not responsible for lost, late, damaged, delayed, incomplete, illegible, or misdirected entries, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the Contest, or other hardware, software or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Contest. Sponsor assumes no responsibility for unseen notifications via Twitter chat or undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or insufficient space in user’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest, as determined by Sponsor, in its sole discretion. Participant may be requested to provide Sponsor with proof that the participant is the authorized account holder of the e-mail address associated with the entry. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.9. DISPUTES:
Each participant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or the Prize, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in the State of New York, (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and the Sponsor in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of New York.
By entering the Contest, participants acknowledge that they are familiar with the provisions of California Civil Code Section 1452, which provides as follows:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM MUST BE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.
INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF THESE OFFICIAL RULES, AND MAY SUBJECT ANY PERSONS INVOLVED TO CRIMINAL AND CIVIL PROSECUTION, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. The Contest is subject to all applicable federal, state and local laws and regulations.11. PRIVACY:
Only an authorized officer of the Sponsor shall have the right to modify or amend these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.13. WINNERS LIST
